Terms & Conditions

 

These terms of service apply to your use and access to our services, which include our website, application, notifications, and any information or material found there (collectively, our "Platform").

These Terms and Conditions (hereafter referred to as "terms") govern how TTEC transports packages, papers, and envelopes ("consignment/shipments") to clients on behalf of a Merchant inside the Republic of Trinidad and Tobago.

Regardless of whether you are a paid or non-paying user, you agree to these conditions by using our Platform. If you are using our Platform on behalf of another company, you are consenting to these terms on their behalf.

Definition

 

“TT Essential Couriers (TTEC)” is the carriage company and shall hereinafter be referred to as “The Company”.

All customers shall hereinafter be referred to as either “Sender/Consignor” or “Receiver/Consignee”.

“Shipment/Consignment means all documents or parcels that travel as a waybill and which may be carried by TT Essential Couriers through any means it chooses.

A “waybill receipt” shall include any Shipment identifier or document produced by TT Essential Couriers (TTEC) or sender automated systems such as a label, bar code, waybill or Consignment note as well as any electronic version thereof.

“Owner’s Risk” means that the goods are held upon terms that TT Essential Couriers shall not be liable for any loss of whatsoever nature and howsoever caused including negligence in relation to the goods or as a consequence of the goods being in your possession. You will indemnify us against all claims that may be made against us arising from the carriage, retention or storage of such goods.

“Carriage” means and includes the whole of the operations and services undertaken by us in connection with the shipment.

 

  1. Scope of Contract

A sender/consignor acknowledges that he or she has read and accepted our terms and conditions of carriage, which may be found on our website at www.ttessentialcouriers.com, unless additional services are agreed to. As a result, by concluding any type of contract with The Company and entrusting a consignment to us, the Sender/Consignor accepts our terms and conditions set forth therein and, on our website, - www.ttessentialcouriers.com, on behalf of him/her or anyone else who has an interest in the shipment, regardless of whether the front of our waybill receipt was signed or not. TTEC's delivery service shall be restricted to the collection, transportation, and delivery of the shipment inside Trinidad and Tobago.

No TT Essential Couriers agent or representative has the ability to change, amend, or waive any of the terms of this contract. TT Essential Couriers will not be bound by directions made orally or in writing that clash with our terms and conditions. The shipper must request special services, which TTEC must confirm in writing. TT Essential Couriers is not a common carrier, and it has the right, in its sole discretion, to refuse carriage to any package or parcel presented for transit.

 

  1. Unacceptable Shipments

A Shipment is deemed unacceptable if:

  1. It contains counterfeit goods, animals, bullion, currency, gem stones; weapons, explosives and ammunition; human remains; illegal items, such as ivory and narcotics,
  2. It is classified as hazardous material(liquid, gas or solid), dangerous goods, prohibited or restricted articles by the laws of Trinidad and Tobago for carriage(“Dangerous Goods”),

Any of the forbidden items listed below must not be included in shipments

 

  1. Its address is incorrect or not properly marked.
  2. Its packaging is defective or inadequate to ensure safe transportation with ordinary care in handling.
  3. Perishable and temperature sensitive goods will not be accepted.
  4. If the COD amount specified on a COD Waybill exceeds the permitted maximum ($10,000 TT).
  5. Packages that weigh more than 70 pounds or have a combined length and girth of more than 3 by 2 feet.

 

  1. Deliveries and Undeliverables
  1. Requests for collection must be verified by 10 a.m. on the day of collection.
  2. Bookings made after 10 a.m. are picked up within 24 hours of the request.
  3. TTEC will notify the sender of the estimated time of collection once a pick-up notice has been received. Once a collection estimate has been issued, senders must notify TTEC of any changes or anticipated delays.Seasons and availability may influence collection timeframes.
  4. Shipments cannot be delivered to PO boxes or postal offices.
  5. Shipments are delivered to the Receiver’s address given by Sender.
  6. Shipments to addresses with a central receiving area will be delivered to that area.
  7. TTEC may notify the Receiver of an upcoming delivery. Receiver may be offered alternative delivery options such as delivery on another day, redirection or collection at another meeting point if listed in a “Hot Spot Zone”.
  8. If the Shipment is deemed to be unacceptable as described in Section 2, or Receiver cannot be reasonably identified or locatedand TTEC has taken all reasonable steps to locate the intended address, or Receiver will not acknowledge deliveryor to pay sum due upon conveyance of the shipment, TTEC shall use reasonable efforts to return the Shipment to Sender at Sender’s cost.
  9. TTEC shall have the right to destroy any Shipment which any law prevents us from returning to Sender as well as any Shipment of Dangerous Goods.
  10. Processed foods in cans, plastic bottles and glass bottles will be accepted and transported provided that the sender accepts that this is at his/her risk. TTEC does not provide special handling for such shipments.
  11. Each driver will be given a maximum of (10) ten minutes free waiting time every collection and delivery. After the allocated time, collection or delivery will be reschedule.
  12. The sender is responsible for the accuracy and completeness of the information entered on the Waybill, as well as ensuring that all shipments include sufficient information for the sender and recipient.
  13. The sender must make certain that the shipment/s are properly packaged and labelled, as well as that their contents are accurately stated.
  14. The sender is responsible for the product's suitable packaging in order to avoid substandard packaging that renders the shipment unable to be securely secured for transit.

 

  1. Inspection

TT Essential Couriers reserves the right to open and inspect a shipment without prior notice to the sender for safety, security, or other regulatory reasons.

 

  1. Documentation of Consignment

 

  1. All customers (Senders/Receivers (where necessary) shall declare the actual contents of their consignment and be bound by the description as written on our waybill receipts. You undertake that it is your responsibility to declare the value of your shipment, and agree that we are not bound to request such information from you. Hence where there is failure to make such declaration, such undeclared shipment is at owners’ risk and TT Essential Couriers shall be free from any liability whatsoever arising from any loss or damage that may arise.

 

  1. The names, addresses and telephone numbers of the consignor and consignee must be provided and we shall not be liable for any loss or delay in delivery occasioned by failure to provide these details.

 

  1. Shipment Charges and Fees

One Flat Rate Nationwide $35

Interisland Rate $40 (coming soon)

  1. TTEC shipment charges are calculated according to the higher of actual or volumetric weight per piece and any piece may be re-weighed and re-measured by TTEC to confirm this calculation.
  2. Packages must not weigh more than 70 pounds or have a combined length and girth of more than 3 by 2 feet.

$35 = 1- 35 lbs                                                     $35 = 0 – 2 by 2 feet

$1.25 per additional lb (36 -70 lbs)                      $10 per additional foot (2 by 3 – 3 by 2)

  1. Cancelled deliveries that have not yet been placed on the delivery truck are eligible for free returns. On the next scheduled shipment, it will be returned.
  2. The sender may be charged a Sender Fee of $15 if the shipment is cancelled by either the Sender or the Consignee when out for delivery.
  3. The full delivery price $35 will be charged if a shipment is cancelled at the delivery site by the sender or the consignee/recipient for circumstances beyond TTEC's control, which includes but is not limited to:
  1. If cancelled deliveries are requested to be returned before the next scheduled shipment, a $25 return fee will be charged.

 

  1. COD and COD Remittance

 

  1. Authorized receivers of shipment shall pay TTEC with cash / linx or cheques in the amount mentioned on the Air Waybill.
  2. Only Trinidad and Tobago currencies will be accepted by TTEC.
  3. TTEC will accept payment on behalf of a sender by linx / credit card or cheque up to a limit of $10,000.00 (TT) per shipment.
  4. Up to $1500 (TT) in cash per shipment
  5. TTEC will receive payment in the form of a check or LINX if a shipper specifies a COD amount on the Waybill that exceeds the allowed limit.
  6. TTEC will pay the sender the net carriage fee through wire transfer to the sender's bank account. Whether or not payment was received, the shipper must notify TTEC in writing within 14 days of the transaction.
  7. The entire payment received by the courier is subject to a 4% fee for credit card transactions.
  8. TTEC shall not be held accountable for any COD payment delays caused by banking processes outside its control.
  9. TTEC will not be accountable for any costs that your banking institution may charge you for deposits made on your behalf, and will not refund you for COD fees.
  10. COD Remittance will be done every Tuesday, for the previous week COD.
  11. Weekly remittance fee $3.00 per transaction.

 

 

 

  1. Packaging of Consignment

Sender or Receiver (where necessary) shall be solely responsible for the packaging (or cost of packaging) of your consignment in such a way that it can withstand normal handling. Consignments of fragile nature must be packed with foam, bubble wrap or any other such protective casing with a “fragile” tag attached thereto. Any loss or damage to a consignment arising out of your failure to pack it in the aforesaid manner is strictly at owner’s risk.

 

  1. TT Essential Couriers Liability

 

  1. TTEC will not be held accountable under a breach contract to conduct carriage of a shipment on behalf of a sender if TTEC suspends or is unable to commence the shipping process due to unforeseeable circumstances over which TTEC has no control, such as (but not limited to):
  1. TTEC will instead notify the customer of the situation within a fair time frame and, with the client's approval, ensuring carriage is started/continued.
  2. TEC shall not be held accountable for any deception or fraud perpetrated by or on behalf of the receiver or sender.
  3. TTEC shall not be liable for any loss or damage including but not limited to
  1. TT Essential Couriers will make every reasonable effort to deliver the Shipment according to our regular delivery schedules, but these schedules are not binding and do not form part of the contract. TTEC is not liable for any damages or loss caused by delay.
  2. TTEC's liability shall be limited to $600.00 (TT) per shipment. (Single or several)
  3. By reporting a higher value on the Waybill and paying the corresponding value premium of 2% of the declared value each shipment, a sender might acquire a higher limit of liability. TTEC shall be accountable for proved damages up to the maximum declared value, and TTEC's legal duty will be TT $10,000.00 (TT)per shipment.

 

 

  1. Claims

 

  1. TTEC will comply with the terms and conditions of this agreement with respect to the receipt and delivery of any shipment, and any legitimate claim by the sender against TTEC with respect to TTEC's obligations in the service intended to be provided must be made by the sender in writing or via email to TT Essential Couriers within fourteen (14) days for any other loss incurred by the sender.
  2. You undertake to notify TTEC of any shortages with COD payments within fourteen (14) days of receiving the reconciliation sheet from TTEC by electronic mail or printed letter. You agree not to hold TTEC accountable for any COD shortages after this time period has passed.
  3. TT Essential Couriers will examine any COD payment deficiencies and, if the issue is resolved in your favour, we will refund the remaining amount as part of your next deposit. The extra amount would be removed from your next deposit if you have an overage.

 

  1. Shipment Insurance

Our goods in transit insurance covers any things being transported by TT Essential Couriers.

  1. Sender’s Warranties and Indemnities

Sender agrees to indemnify and hold TT Essential Couriers blameless for any loss or damage caused by Sender's breach of the following warranties and representations:

 

  1. Governing Law

Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of Law, and governed by the law of the Republic of Trinidad and Tobago, for the benefit of TT Essential Couriers, and the sender irrevocably submits to such jurisdiction, unless contrary to applicable law.

 

  1. Entire Agreement & Severability

TTEC intends for this document to cover all of the terms of the contract between TTEC and the sender. Before the consignment is approved for transportation by TTEC, the shipper must ensure that any alteration to these conditions is recorded in writing and signed by the shipper and on behalf of TTEC. If any portion of these conditions is found to be unenforceable, the enforceability of the other provisions will not be affected.

 

  1. Variation of Terms

We may amend these terms from time to time by posting the updated terms on our Platform. If we make material changes, we will notify you of the changes before they become effective.
